German sociologist Max Weber 1864-1920 described bureaucracy as a desirable form of organization, especially for efficiency and the fair and equitable treatment of clients and employees. To aid in efficient administration, ‘representativeness’ helps assure the government bureaucracy is responsive to the needs of citizens. Clearly, equality in recruitment in gender and indeed for all minorities for public organizations thru active representation produces government administration results more responsive to the public’s need

This presentation discusses discrimination in hiring using artificial intelligence in relation to public administration organization theory from the perspective of fairness and established US Law. Though still in use today, artificial intelligence employment screening systems have proven to be discriminatory and in violation of US law, regulation, and statutes. The US is a representative government, and the rules are established to assure the government remains responsible to the people, ‘representativeness’ helps assure the government bureaucracy is responsive to the needs of citizens. Clearly, discrimination as seen in all artificial intelligence human resources hiring systems does not produce representative organizations responsive to the public’s needs.
